1. ACCEPTANCE OF TERMS

These Terms and Conditions ('Terms') constitute a legally binding agreement between you ('User', 'you', 'your') and 36Gunn ('we', 'us', 'our', 'Platform'). By accessing, browsing, registering, or using this platform in any manner, you agree to be bound by these Terms.

Your continued use of the Platform following any modification to these Terms constitutes your acceptance of the revised Terms.

2. ELIGIBILITY CRITERIA

To register and use this Platform, you must satisfy ALL of the following conditions:

• You are at least 18 years of age (females) or 21 years of age (males) as per the Prohibition of Child Marriage Act, 2006.
• You are legally eligible to marry under applicable Indian personal laws including but not limited to the Hindu Marriage Act 1955, Special Marriage Act 1954, Muslim Personal Law, or Indian Christian Marriage Act 1872.
• You are not currently in a subsisting valid marriage unless legally divorced or widowed, with documentary proof.
• You are a citizen or resident of India, or an Indian national residing abroad (NRI/PIO/OCI).
• You have full legal capacity to enter into a binding agreement.
• You are registering for yourself or, if registering on behalf of a family member, you have their explicit consent to do so.

We reserve the right to terminate accounts found to be in violation of these eligibility criteria without prior notice.

3. REGISTRATION AND ACCOUNT SECURITY

3.1 Profile Creation

You agree to provide accurate, current, truthful, and complete information when creating your profile. Misrepresentation of any information including but not limited to name, age, marital status, educational qualifications, occupation, income, or photographs is strictly prohibited.

3.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials. You agree to immediately notify us of any unauthorized use of your account. We shall not be liable for any loss arising from unauthorized use of your account.

3.3 One Account Policy

Each individual may maintain only one active account on this Platform. Creating multiple accounts is strictly prohibited and will result in permanent suspension.

4. USER CONDUCT AND PROHIBITED ACTIVITIES

You agree NOT to use this Platform for any of the following:

• Submitting false, misleading, or fraudulent profile information or photographs.
• Concealing or misrepresenting current marital status, including hiding prior marriages.
• Soliciting or accepting dowry in any form, which is a punishable offence under the Dowry Prohibition Act, 1961.
• Engaging in financial fraud, cheating, impersonation, or identity theft.
• Posting obscene, vulgar, defamatory, communally sensitive, or offensive content.
• Harassing, threatening, abusing, or intimidating other users.
• Sharing or soliciting Aadhaar numbers, PAN cards, bank account details, or financial information.
• Using the platform for commercial solicitation, advertising, or promoting any business.
• Attempting to hack, disrupt, or gain unauthorized access to the Platform or other users' accounts.
• Reproducing, distributing, or misusing any data or profiles from this Platform.
• Registering minors or creating profiles on behalf of individuals below the legal marriageable age.
• Violating any applicable local, state, national, or international law or regulation.

Violation of any of the above may result in immediate account suspension, reporting to law enforcement authorities, and civil or criminal action under applicable Indian law.

5. PRIVACY AND DATA PROTECTION

5.1 DPDP Act Compliance

We are committed to compliance with India's Digital Personal Data Protection Act, 2023 (DPDP Act). Your personal data is collected, processed, and stored solely for the purpose of facilitating matrimonial matchmaking.

5.2 Data Collection

We collect personal information including name, age, contact details, photographs, educational and professional background, and preferences. This information is used exclusively for the purposes of this Platform.

5.3 Your Rights

Under the DPDP Act, 2023, you have the following rights regarding your personal data:

• Right to access your personal data held by us.
• Right to correct inaccurate or outdated personal data.
• Right to erasure of your personal data upon closure of your account.
• Right to withdraw consent for data processing at any time.
• Right to grievance redressal through our Grievance Officer.

5.4 Data Sharing

We do not sell, rent, or share your personal data with unauthorized third parties. Profile information is visible only to registered users of this Platform as per your privacy settings.

5.5 Consent Logs

We maintain digital records of your consent to these Terms, Privacy Policy, and data processing activities, including the date, time, and IP address of your consent, in compliance with applicable law.

6. CONTENT AND INTELLECTUAL PROPERTY

All content on this Platform including text, graphics, logos, design, and software is the intellectual property of 36Gunn and is protected under the Copyright Act, 1957, and applicable Indian intellectual property laws.

Users grant 36Gunn a non-exclusive, royalty-free, worldwide licence to display and use their uploaded profile content (photographs, descriptions) solely for the purpose of operating and promoting the Platform.

You must not reproduce, distribute, or commercially exploit any content from this Platform without prior written consent.

7. DISCLAIMER OF WARRANTIES

This Platform is provided on an 'as is' and 'as available' basis. We expressly disclaim all warranties, whether express or implied, including:

• Accuracy, completeness, or reliability of any user profile or information.
• Compatibility or suitability of any matrimonial match suggested by the Platform.
• Uninterrupted, error-free, or secure access to the Platform at all times.
• Outcomes of any alliance, marriage, or relationship arising from use of this Platform.

We strongly advise all users to conduct independent verification and due diligence before meeting or entering into any matrimonial commitment.

8. LIMITATION OF LIABILITY

To the maximum extent permitted under Indian law, 36Gunn and its owners, directors, employees, agents, and affiliates shall not be liable for:

• Any direct, indirect, incidental, consequential, or punitive damages arising from use or inability to use this Platform.
• Any financial loss, emotional distress, or reputational harm arising from interactions with other users.
• False, fraudulent, or misleading information provided by third-party users.
• Unauthorized access to or alteration of your account or data due to your own negligence.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability which cannot be limited under applicable Indian law.

9. SUBSCRIPTION, PAYMENTS AND REFUNDS

Certain features of this Platform may be available on a paid subscription basis. The following applies to all paid services:

• All payments are to be made in Indian Rupees (INR) through secure payment gateways.
• Subscription fees are non-refundable once the paid features have been accessed, except where required by law.
• We reserve the right to modify subscription pricing with 30 days prior notice to users.
• In the event of account termination due to violation of these Terms, no refund shall be provided.
• For billing disputes or queries, please contact us at billing@36gunn.in within 7 days of the transaction.

10. ACCOUNT SUSPENSION AND TERMINATION

We reserve the right to suspend or permanently terminate your account, with or without prior notice, if:

• You are found to be in violation of any of these Terms.
• Your account is used for fraudulent or illegal activities.
• You submit false or misleading profile information.
• We receive verified complaints of misconduct against you from other users.
• Your continued presence poses a risk to the safety of other users or the Platform.

You may also deactivate or delete your account at any time by contacting us. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy and applicable law.

11. GRIEVANCE REDRESSAL

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer:

Users may lodge complaints regarding violation of these Terms, content concerns, or data-related grievances with the Grievance Officer through the above contact details.

12. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts located in India.

In the event of any dispute, the parties shall first attempt resolution through good-faith negotiation. If unresolved within 30 days, the dispute may be referred to arbitration under the Arbitration and Conciliation Act, 1996.

13. MODIFICATIONS TO TERMS

We reserve the right to modify, update, or revise these Terms at any time at our sole discretion. Users will be notified of material changes via email or a prominent notice on the Platform. The revised Terms will be effective from the date of publication.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue use of the Platform.
